Terms of Service

1. The service

ListFly lets you upload property photos and videos and use artificial intelligence to: generate drone-style video scenes, edit photos (light, sky, virtual staging, virtual renovation and more), build the video storyboard and write listing copy.

AI features rely on third-party providers (for example OpenAI, MiniMax and Mapbox). AI output may contain inaccuracies and must be reviewed by you before any publication.

2. Account and eligibility

You must be 18 or older and provide accurate information. You are responsible for keeping your access secure and for all activity in your account.

3. Plans, payments and cancellation

Paid plans are billed on a recurring basis (monthly or yearly) through the payment processor Stripe until you cancel. One-off purchases (single listing and scene pack) are charged once.

You may cancel at any time; your plan stays active until the end of the period already paid, with no further charges. Unused monthly quotas do not roll over, except one-off credits, which do not expire while the account exists.

Right of withdrawal: where applicable consumer law grants it (for example, art. 49 of Brazil’s Consumer Code or EU distance-selling rules), you may withdraw within the legal period and receive a full refund.

Prices may change with at least 30 days’ prior notice; changes apply from the next renewal.

4. Your content

You keep all rights to the photos, videos and text you upload and to the output generated from them, subject to the AI providers’ terms.

You grant us a limited, non-exclusive, revocable licence to store, process and send that content to AI providers strictly to deliver the service you requested.

You confirm you are authorised to use the content you upload (for example by the property owner and the photographer) and to advertise the property.

5. Prohibited use

You may not use the service to: (a) create misleading listings, such as hiding defects or inventing rooms, views, finishes or areas without a clear notice; (b) upload images of people without consent, or of children; (c) infringe copyright, image or privacy rights; (d) remove AI transparency labels to deceive the public; (e) circumvent limits, resell access or reverse-engineer the service.

We may suspend accounts that break these rules, without prejudice to other legal remedies.

6. AI-generated content

AI-generated or AI-altered videos and photos are illustrative and may differ from the real property. You are solely responsible for reviewing the material, disclosing when it was altered and making sure the published listing is truthful, as set out in the AI Use Policy.

7. Availability and limitation of liability

The service is provided "as is". We make reasonable efforts to keep it available, but failures may occur, including at AI providers. To the maximum extent permitted by law, our total liability is limited to the amount you paid in the 12 months before the event, and we are not liable for lost profits, lost business or how you use published content. Nothing in these Terms limits consumer rights that cannot be waived by law.

8. Changes, governing law and contact

We may update these Terms; material changes will be announced in the app and you may accept them or close your account. These Terms are governed by the laws of Brazil, with jurisdiction in [CIDADE/UF], without prejudice to mandatory consumer-protection rules of your country of residence.
